    3. Payments and Commissions
    The website MarineHubs.com uses a secure system for processing payments between Clients and Providers. Below is an overview of the payment process and commission system:

    3.1 Client Payment Process

    1. Price Acceptance: After reviewing the prices provided by the Providers, Clients must choose one within 48 hours. If the Client does not choose a price within this period, a negative point will be recorded for the Client.


    2. Payment by Client: After accepting the price from the Provider, the Client must pay 1.5% of the quotation amount as the website’s commission. This amount is automatically calculated by the website.


    3. Payment Method: Payment can only be made through the secure online payment gateway using a bank card.


    4. Escrow Payment: After the Client’s payment, the money is held in escrow by the website and is only released to the Provider once the Provider has paid their commission. If the Provider does not pay the commission, the money will be refunded to the Client.



    3.2 Provider Payment Process

    1. Provider’s Commission: Providers must pay their commission to the website after the Client’s payment and price acceptance. This step is essential to share the contact information between the Client and Provider through the website.


    2. Commission Payment Deadline: Providers have 24 hours after the Client’s payment to pay their commission. If payment is not made within this time, the Provider’s profile will be locked.
    3. Extended Deadline: If the Provider does not pay their commission, they will be contacted and given an additional 12 hours. If payment is not made within this period, the Provider’s profile will be locked, and penalties for violating website rules will be applied.

    4. Contact Information Transfer: Only when both parties have successfully completed their payments, the contact information of the Client and Provider will be shared, and a chat window will be activated for further communication.



    3.3 Penalties for Non-Compliance with Rules

    1. Non-Payment of Commission: If the Provider does not pay their commission after the specified deadline, their profile will be locked, and financial penalties for violating the rules will be applied. The Provider may also be removed from the website and permanently banned.


    2. Abuse of Payment System: Any attempt by the Provider to manipulate the payment system or reduce the commission by entering incorrect prices will result in price correction and recalculation of the commission. The Provider will be required to pay the adjusted commission, and their profile will be penalized.


    3. Legal Action: The website reserves the right to take legal action against any party (Client or Provider) in case of contract violation or damage to the website’s reputation. The amount of damages to the website’s reputation and business will be determined according to applicable laws.



    3.4 Refunds and Dispute Resolution
    1. Refund Policy: If the Provider fails to properly perform the requested service after payment by the Client and price acceptance, the Client has the right to request a refund. The website will manage the refund process according to its conditions.


    2. Dispute Resolution: In the case of a dispute between the Client and Provider, the website will act as a mediator. Both parties are required to follow the website’s dispute resolution process to ensure that the process is fair and just for both parties.

Upon termination of this Agreement, you shall cease all use of the website and delete all copies of the website from your computer.

Termination of this Agreement will not limit any of MARINEHUBS’s rights or remedies at law or in equity in case of breach by you (during the term of this Agreement) of any of your obligations under the present Agreement.

No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and MARINEHUBS’s failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision. YOU AND MARINEHUBS AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute waiver of any subsequent breach.

No failure to exercise, and no delay in exercising, on the part of either party, any right or any power under this Agreement shall operate as a waiver of that right or power. Nor shall any single or partial exercise of any right or power under this Agreement preclude further exercise of that or any other right granted herein. In the event of a conflict between this Agreement and any applicable purchase or other terms, the terms of this Agreement shall govern.

Amendments to this Agreement

MARINEHUBS reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Please note that all Promotions may be governed by separate rules that may contain certain eligibility requirements, such as restrictions as to age and geographic location. Typographical Errors
